Secure Patentability Rights even after Publication

Secure patentability rights while allowing publication and commercialization of claims and trade secrets prior to submitting a patent application.

 

Use the provisonal patent application database as a trade secret database [e.g., a Trade Secret Bank] that is searchable by a community of qualified members of the Bank who demonstrate that they will not use the information in the Bank for any purpose except to enter into license or purchase arrangements with the provisional patent applicant. In addition, use the information in the Bank as prior art and allow the provisional patent applicant to maintain patentability rights as long as every reasonable effort is exercised to commercialize the claims or trade secrets that are contained in the applicant's application. Allow the applicant to publish original claims or trade secrets contained in the provisional patent application without loosing patentability rights for as long as the applicant engages in reasonable efforts to commercialize the claims or trade secrets contained in the provisional patent application. Encourage the provisional patent applicant to proceed to the patent application process after sufficient funds have been raised from commercialization activities.
